The rules for using UPSCALR, in plain language.

This document describes how UPSCALR actually works today, written by the team that built it. It has not been reviewed by qualified counsel and should not be relied on as a finished legal instrument until it has been.

The agreement

By using UPSCALR you agree to these terms. The service is operated by Deepsoch AI Private Limited, India. If you are using UPSCALR on behalf of an organisation, you confirm you may bind that organisation.

Your account

  • You must be able to form a binding contract to hold an account.
  • You are responsible for what happens under your account, including anything done with your API keys. Keep them secret; treat a leaked key as compromised and revoke it.
  • Give us a real email address. It is how we send verification, password resets and billing notices.
  • One person or organisation, one account.

Your images stay yours

You keep all rights to the images you upload and to the upscaled results. We claim no ownership. You grant us only the narrow, temporary permission needed to store your images and pass them to our processing provider so we can return a result to you. We do not use your images to train models.

You are responsible for having the right to upload what you upload.

Acceptable use

You may not use UPSCALR to process:

  • Material that sexualises children, in any form.
  • Images you have no right to use, including copyrighted work that is not yours and not licensed to you.
  • Content created to impersonate a real person, forge a document, or deceive people about something that did not happen.
  • Material that is unlawful where you are, or where we operate.

You also may not attempt to break, overload or reverse-engineer the service, evade the free-tier limits with multiple identities, or resell raw API access as a competing upscaling service.

We may suspend an account for a clear breach. Where the breach is not severe we will tell you what the problem is and give you a chance to fix it first.

Credits, plans and payment

  • Processing consumes credits. Larger output sizes consume more, because the work is proportionally larger.
  • Credits are reserved when a job starts and charged when it succeeds. A failed or cancelled job releases its reservation. You are not charged for work that did not produce a result.
  • Subscription credits are granted each cycle. Credits already granted do not expire, and remain usable if your subscription ends.
  • Credit packs are one-off purchases. They do not renew and do not expire.
  • Prices are shown before you buy. We may change them, but never for a cycle you have already paid for.

Refunds

If the service fails to deliver what you paid for (a job that we charged for but never returned, or a duplicate charge), tell us and we will refund it. We do not generally refund unused credits or a change of mind, and credits are not refunded when you delete your account.

Availability

We aim to keep UPSCALR running and publish live status at /status, but we do not offer a contractual uptime guarantee. Processing depends on a third-party inference provider, and an outage there will interrupt the service.

Results

Upscaling is a model's best reconstruction, not a recovery of detail that was never captured. It invents plausible detail. Do not rely on an upscaled image as evidence of what something actually looked like, and do not use it where forensic or diagnostic accuracy matters.

Liability

UPSCALR is provided as-is. To the extent the law allows, our total liability to you for any claim is limited to what you paid us in the twelve months before it arose. Nothing here limits liability that cannot lawfully be limited.

Ending the agreement

You may stop using UPSCALR and delete your account at any time from Settings. We may terminate an account for a serious breach of these terms, or with reasonable notice if we discontinue the service, in which case we will refund the unused portion of any active subscription.

Governing law

These terms are governed by the laws of India, and the courts of India have jurisdiction over any dispute.

Changes

We will update the date above when these terms change and email account holders about material changes before they take effect. Continuing to use UPSCALR after that means you accept them.
